Meaning of Agency By Estoppel
A relationship imposed on parties by law. Arises where a principal , by negligence in supervising the affairs as conducted by the agent, allows him to exercise powers not granted to him, thus justifying others in believing that the agent possesses requisite authority. Sometimes referred to as the agent's ostensible authority , which term would properly apply to all such matters that one would normally expect an agent to possess in the particular circumstances of a given transaction.Where one has so acted from his conduct to lead another to believe that he has appointed someone to act as his agent, and knows that that other person is about to act on that behalf, then, unless he interposes, he will, in general , be estopped from disputing the agency, though in fact no agency really existed. See reserve Ins. Co. v Duckett, 214 A.2d 754, 240 Md. 591.
