Meaning of Distress
The taking, without legal process , of a personal chattel from the possession of a wrongdoer into the hands of a party aggrieved , as a pledge for the redressing and injury , the performance of a duty, or the satisfaction of a demand. The term also signifies the property distrained.
Distress Alternative Definition
(Fr. distraindre, to draw away from). The taking of a personal chattel out of the possession of a wrongdoer into the custody of the party injured, to procure satisfaction for the wrong done. 3 Bl. Comm. 6. It is generally resorted to for the purpose of enforcing the payment of rent, taxes, or other duties, as well as to exact compensation for such damages as result from the trespasses of cattle. This remedy is of, great antiquity, and is said by Spelman to have prevailed among the Gothic nations of Europe from the breaking up of the Roman empire. The English statutes since the days of Magna Charta have, from time to time, extended and modified its features to meet the exigencies of the times. It was at one time generally in vogue in the United States, but is now generally abolished, the remedy of attachment taking its place.

In the context of the English law, A Dictionary of Law provides the following legal concept of Distress:
The seizure of goods as security for the performance of an obligatio The two principal situations covered by the remedy of distress are (1) between landlord and tenant when the rent is in arrears (See distress for rent); and (2) when goods are unlawfully on an occupier's land and have done or are doing damage (See also distress damage feasant). In the latter case the occupier may detain the chattel until compensation is paid for the damage.
