To pledge without parting with possession to the pledgee , as security for a debt. Hypothecation is a civil law concept and the closest the common law approaches hypothecation are bottomry bonds and the claim of seamen for wages who have a lien against the ship.
Hypothecate Alternative Definition
To pledge a thing without delivering the possession of it to the pledgee. "The master, when abroad, and in the absence of the owner, may hypothecate the ship, freight, and cargo, to raise money requisite for the completion of the voyage." 3 Kent, Comm. 171.
