Meaning of Justiciability
The term is frequently used in ascertaining the jurisdiction of federal courts over given matter. under the doctrine of justiciability the jurisdiction of federal court is restricted to questions presented in adversary context and in form historically viewed as capable of resolution through judicial process , and in part the term defines the role assigned to judiciary in the tripartite allocation of power to assure that federal courts will not intrude into areas committed to other branches of the government. The term is thus one of art employed to give expression to this dual limitation. See Flast v Cohen, 392 U.S. 83, 88 S. Ct. 1942, 20 L.Ed.2d 947. where a question presented to court is a political question, because of the separation of powers provided by constitution , the court will not have jurisdiction to adjudicate upon the same. See committee tofreethe Fort Dix38 v Collins, (C.A.N.J.) 429 F.2d 807.
