Meaning of Parol Evidence
The testimony of a witness by word of mouth. Oral evidence. where an agreement or understanding between parties is reduced to writing , then evidence of all prior and contemporaneous understanding of the parties to such agreement is incompetent. The rule is founded upon the principle that where parties have reduced to writing their understanding or agreement, if such writing is clear and unambiguous, it furnishes the best evidence of the terms of the agreement and what the parties intended. parol evidence of antecedent understandings and negotiations will not be received by the court for the purpose of varying or contradicting the written agreement. See Andrews v Deering Milliken, Inc., (C.A.6)382 F.2d799.
