Meaning of Procedure
The mode of proceeding by which a legal right is enforced; the mode in which the successive steps in litigation are taken. That which regulates the formal steps in an action or other judicial proceeding. The law of procedure is also called adjective law , as opposed to substantive law. See federal rules of civil procedure , Appendix 3. The common law recognizes no vested rights in procedure, and a party invoking the jurisdiction of the court must take procedure as he finds it. The conception of procedure is, in this connection, a comprehensive one, including process and evidence , methods of execution , rules of limitations affecting the remedy and the rules of the court with regard to the kind of relief that can be granted to a suitor , but it does not extend to substantive rights. In narrowest sense, the term is limited to writs or writings issued from an act of court under the seal of the court and returnable to the court.
