Meaning of Sovereign Immunity
A principal of jurisprudence whereby the state cannot be sued unless it has given its consent or has otherwise waived its immunity. This doctrine is of judicial origin founded on the ancient principal that the King can do no wrong; it is no longer in much favor with the courts. See Lansing v county of MacLean, 359 N.E.2d 165, 45 lll.App.3d 91. The judicial power granted by the constitution to the United States will not extend to entertaining a suit brought by a citizen against his own state, without its consent. See Duhne v New Jersey, 251 U.S. 311, 40S.Ct. 154,64L.Ed. 280.
