Meaning of Zoning
Zoning is the act of prescribing the mode in which lands within certain stated divisions of a municipality can be used by their owners or occupants. The legislative division of a community into areas in each of which only certain designated uses of land are permitted so that the community may develop in an orderly manner in accordance with a comprehensive plan. See Best v. Zoning Board of Adjustment, 393 Pa. 106,141 A.2d606. Zoning is part of the urban planning process and is within the power of the municipalities. It is the means by which a municipality enforces its overall plans for urban development within its limits by preventing, controlling and regulating the uses to which land can be put. The process of zoning necessarily restricts the exercise by an owner of land of his rights of ownership in the interest of the benefits to be derived from such restrictions for the whole community.
